On a case-by-case basis, FlexFundz may also provide financing directly to qualified businesses, subject to our applicable underwriting criteria, approval requirements, and the terms of the applicable financing agreement.
Whether financing is provided directly by FlexFundz or through a third-party funding provider will depend on the circumstances of the transaction and the applicable approval and underwriting requirements.
We do not guarantee approval, funding amounts, rates, repayment terms, or any other specific financing terms.
3. No Guarantee of Funding
Submitting an application does not guarantee approval or funding.
For financing provided directly by FlexFundz, all financing decisions are subject to FlexFundz’s applicable underwriting, approval criteria, and financing terms.
For financing facilitated through a third-party funding provider, the applicable funding provider makes the financing decision and determines the applicable financing terms.
FlexFundz does not guarantee that any particular financing product, approval, funding amount, rate, or repayment term will be available to you or your business.
4. Eligibility
You must be at least 18 years of age and authorized to act on behalf of the business for which you are submitting information or applying for financing.
By using our services, you represent that the information you provide is accurate and that you have the authority to provide information on behalf of the business.
5. Accuracy of Information
You agree to provide complete, accurate, and truthful information when using our website or services.
You agree to promptly update information if it becomes inaccurate or incomplete.
Providing false, misleading, or fraudulent information may result in denial of services, termination of an application, or other action as permitted by law.
6. SMS/MMS and Electronic Communications
By providing your telephone number and separately opting in to receive SMS/MMS communications, you agree that FlexFundz may send text messages to the number provided.
SMS/MMS communications may include both transactional and promotional messages, depending on the type of consent you provide.

Promotional messages may include information regarding financing products, services, offers, opportunities, or other marketing communications from FlexFundz.

Consent to receive promotional SMS/MMS messages is not a condition of applying for or receiving financing from FlexFundz.
SMS consent is voluntary and is not required to submit an application.
You may opt out of SMS/MMS communications at any time by replying STOP. You may text HELP for assistance.
Opting out of promotional messages does not necessarily prevent FlexFundz from sending necessary transactional communications relating to an existing application or account, where permitted by applicable law.
7. Email and Other Electronic Communications
By providing your email address or other contact information, you agree that FlexFundz may communicate with you electronically regarding your application, account, services, customer support, and other matters related to your relationship with FlexFundz.
Where required by law, you may withdraw consent to electronic communications through the methods provided in the applicable communication.

Financing decisions are made by the applicable third-party funding provider.

FlexFundz is not responsible for financing decisions, terms, actions, or omissions of third-party funding providers.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
